II. Exerting Supervision Function to Establish
a New Mode of Trademark Protection
Trying out to establish a notification system of trademark licensing.
In the recent years, a lot of well-known foreign trademark commodities
entered into Chengdu; to solve problems of the nonstandard use of
trademark licensing, avoid the occurrence of trademark infringement
and counterfeit activities, and safeguard rights of trademark registrants
and interests of consumers, Chengdu put forward a new supervision
mode-a notification system of trademark licensing, which meant that,
the industrial and commercial administration would review those licensed
trademarks in commodities circulation field; if trademarks accorded
with provisions of Trademark Law, they will be notified
to the public. The Municipal Industrial and Commercial Bureau took
the lead in notifying licensed trademark of such commodities as clothes
and shoes in Jiulong Square, Dacheng Square and Hehuachi Square, which
not only moved forward the pass of trademark supervision, but also
gained fairly good social effects.
In May 2002, Chengdu was chosen as a national
experimental city on patents. Chengdu Municipal Government issued
documents like the Plan for Experimental Patent Units in Chengdu.

Carrying out the activity of ˇ°combination of cities and villages
with the aid of industrial and commercial bureausˇ± to do well in cultivation
of trademarks of agricultural products and by-products. According
to the actual situation that the number of trademark registration
of agricultural products was very small, and the using rate of trademarks
after being registered was very low, the Municipal Industrial and
Commercial Bureau, in the principal of ˇ°general guidance, main support,
protection of registered trademarks and creation of famous brandsˇ±,
strengthened the cultivation of agricultural trademarks, and provided
specific guidance to Taipinglongshi fruits and Zongfu fruit industry
on use of trademarks, promoted trademarks innovation and accelerated
the development of agricultural industry.
Authorizing and protecting famous trademarks according to laws. In
2004, Trademark Bureau of State Administration for
Industry and Commerce authorized 3 trademarks, Shenda,
Tongwei and Huangchenglaoma as well-known trademarks; 33
municipal famous trademarks were newly authorized, and 16
municipal famous trademarks reviewed by Chengdu Industrial and Commercial
Bureau.
Strengthening administrative law enforcement of trademarks. In 2004,
industrial and commercial departments at all levels in our city focused
on protecting the right to the exclusive use of registered trademarks,
and took stern measures to investigate into and solve a batch of trademark
infringement and counterfeit cases. Statistics showed, in the whole
year, 248 illegal cases of trademark infringement
and counterfeit were investigated into and solved, and an amount of
1.4558 million RMB was confiscated. In the meantime, according
to the unified deployment of Working Plan on Carrying out
the Protection of Proprietary Use Right of Registered Trademarks,
issued by State Administration for Industry and Commerce, the special
actions of registered trademarks protection was carried out within
the whole city, which focused on investigating into and handling cases
of food and medicine trademark infringement, cases of foreign-related
trademark infringement, and trademark printing enterprises. 6150
person times of law-enforcement personnel were sent out, and 97
dens producing and selling counterfeit trademarks were destroyed,
giving a forceful blow to the trademark-related illegal activities.
