VII. Enhance Law Supervision
to Form a Resultant Force of Law Enforcement
Based upon the law supervision, Chengdu procuratorial organs has
set up the concepts of overall situation, and from the point of being
beneficial to safeguard economic orders in socialist markets and fight
against criminal activities of destroying economic orders of socialist
economy, cooperated closely with the public security departments,
administrative organs for law enforcement, and strengthened crackdown
on criminal activities of infringing intellectual property rights.

supervision, and guaranteed the excellent quality and high efficiency
of case handling. Through the combination mechanism between administrative
law-enforcement and criminal law-enforcement, it, together with administrative
organs for law enforcement, regularly convened liaison meetings on
taking special actions to supervise recording of criminal activities
of intellectual property infringement through exercising right to
learn the truth, right of suggestion, and right to start criminal
proceedings, it was guaranteed that the administrative law-enforcing
organs could turn in time the suspect criminal cases to the public
security departments, and then the latter could accept and solve those
cases in time, thus the resultant force fighting criminal activities
of intellectual property infringement could be formed and the phenomenon
of ˇ°punishment in replace of penaltyˇ± was eliminated. In 2004,
the procuratorial departments took special actions to supervise recording
of criminal activities of intellectual property infringement, and
in accordance with the emphasis of crackdown in this city, publicly
supervised and handled the major cases. It handled in succession a
batch of cases with significant social effects, such as Adidas, Nike
and other trademarks counterfeit cases, Zhanghua cigarettes counterfeit
case and famous liquors counterfeit cases. In the whole year, it had
accepted and heard 10 intellectual property rights
infringing cases submitted by the public security organs for approval
of arrest (involving in 16 persons), approved to
arrest 7 persons in 4 cases, and
took proceedings against 8 persons in 5
cases.
